I was over at www.espn.com reading this article http://sports.espn.go.com/nba/news/story?id=3822392 when I noticed this statement...

League sources told ESPN.com that the Phoenix Suns' Robert Sarver is the only other owner so far who has continued the leaguewide e-mail discussion. Following up Gilbert's note with a brief question directed at the Blazers, Sarver wrote, "Are you saying we're not allowed to sign him?"

Is that just Sarver asking the Blazers to clarify or is there something behind it?

Sarver better not be interested in Miles. You don't bite the hand that feeds you.

Haha, I really hope Sarver is being sarcastic there and doesn't really think Phoenix isn't allowed to sign him. Hell Im all for the Suns signing him and letting him play a minute in 2 games just to piss off the Blazers. We're not going anywhere anytime soon, may as well screw over a conference rival :D

I'd rather sign him, then force the blazers to trade us our draft picks back for him.

Hmmm. I'd probably try to extort Roy/Bayless or Aldridge/Bayless out of them.

Sarver: "We have a deal on the table to sign Miles. We haven't delivered the contract yet. How much are Roy/Bayless or Aldridge/Bayless worth to you?"

That was pretty ballsy for POR to make that threat, first time ever a team has threatened other teams to not sign a FA and Miles could countersue them on the basis they are limiting his right to work according to ESPN. I figure teams should do it as it would limit them in FA this offseason and stop the rich from getting richer.

One should sign him simply to bust the Blazers. They have exploited this situation and got benefits because of the fact that Miles was judged incapable of playing basketball again.

But obviously he is healthy enough to play, so they should not have ever gotten those benefits.

The Suns got nada when Penny and Googs were severly injured. Portland shouldn't have gotten benefits from Miles injury and on top of that they have one of the richest owners.

I think Sarver is obviously sarcastic in his respone, if I were him I'd sign Miles asap just because of that email.

The Blazers are top class cheaters who circumvented the rules of the salary cap.

Why don't the Blazers sign him?

Im pretty sure they can't per the terms of the agreement. Since he was deemed unable to play physically the Blazers got a sweet deal from the league, but I believe part of it was that he can't sign back with Portland and then just have them refuse to play him.

EDIT: Also more importantly, why would Miles sign there? First he's probably not too happy with the Blazers, secondly he knows they'd just be trying to bury him on the bench and avoid playing him.

" 'Team Presidents and General Managers,
'The Portland Trail Blazers are aware that certain teams may be contemplating signing Darius Miles to a contract for the purpose of adversely impacting the Portland Trail Blazers Salary Cap and tax positions. Such conduct from a team would violate its fiduciary duty as an NBA joint venturer. In addition, persons or entities involved in such conduct may be individually liable to the Portland Trail Blazers for tortuously interfering with the Portland Trail Blazers' contract rights and perspective economic opportunities.
'Please be aware that if a team engages in such conduct, the Portland Trail Blazers will take all necessary steps to safeguard its rights, including, without limitation, litigation.' "

It's tortious interference, not tortuous. Intimidation 101--if you want a threat of litigation to be taken seriously, don't misspell the tort you allege will be committed.

I so hope the Grizzlies play him 2 games.... The Blazers crossed the line with their threats and by trying to back out of their commitment to Miles who should obviously not be medically retired

Ummm.....no. Try again. They got it right. I'm guessing they had a lawyer or two look it over before they hit send.

Actually.... I believe Kolo was correct. Tortious interference is legal jargon describing when a person(s) intentionally damage a plaintiff's contractual or other business relationships.

p.s. Kolo is a lawyer.

Maybe we should stick with nouns tort and torture. :)

The Blazers clearly crossed the line in the matter. If this commissioner could apply rules fairly (which he does not), he would fine and take away draft picks from the them. He did take away 5 number 1 draft picks for the TWolves trying to do an under the table deal with Joe Smith. The rule is for players that cannot play. It has been used for Cutino Mobley and Eric Snow. The Suns also used it for Rex Chapman a few years ago. In all these cases they obviously cannot play. Miles has been medicaly cleared to play. It does not matter if he does not play well. If a team signs him just to stick it to Portland they have the right to do so.

Wow -- you don't suppose that the fact that the Blazers are now the only NBA franchise left in the booming Pacific Northwest, plus their owner is a billionaire, could be anywhere near Stern's mind, do you? :thud:
