Wonder if he was coached proactively by someone to refuse the field sobriety test. I would imagine that the time between then and the blood test could really bring down the BAC. Anyone know for sure?

Also..... If he lies to the officers..... Is that better or worse in Bidwills eyes than Floyd lying straight to his face. Not sure Mr. Bs take on thus as he is a lawyer.

Not sure.

I think standard defense attorney advice on this is always refuse the field tests if you have had anything to drink -- you will likely be arrested at that point and be given a blood test at the station.

The logic being: if they ask you to do a field test, the LEO thinks you are impaired and the results can only hurt you.

I'll be honest. I play golf 3-4 times a week, usually sit around and have 2-3 beers afterward, and then drive home. With no food and 4 hours on the course, I'd bet, if pulled over, I'd be legally over the limit. Does that make me a scourge on society and call for total outrage?

I've heard about your golf game, I'm surprised you didn't have 8 just to try and forget that round... :lmao:

I'm interested in this too. I mean, if he said, "Yeah, I'm GM of the Cardinals." that might work against him or in his favor. They might go easy on him or go hard on him, but it's probably best to let the lawyer deal with that. As GM, he wears many hats. I really don't think that'll be held against him.

Being in the public eye he could have been coached to keep his position on the down low if something like this happened.

The courts no longer consider "but I've never done this before" as a mitigating circumstance. Data shows people who get arrested for any kind of DWI or DUI have driven drunk at least 10 times before. So please don't break out with this platitude. The various municipal courts have formal punishments based on the BAC. Attorneys know this and practice within those guidelines.

Are you a lawyer? Because this is simply a lie. First time offenders get cut a break all the time. I used to do DUI defense and work in a law firm with 4 lawyers who do DUI defense every day. Don't come in here and make things up to appear more virtuous - its really not becoming.

Time can help you or hurt you. Depends on when he quit drinking in relation to the stop... Many people’s BAC can still be going up...

Radio said he refused field test because of bad knees.

what? this just looks and sounds dumber and worse with every little detail.

Being drunk enough to not know what position you hold in the organization is concerning.

Can't even imagine how awkward this must have been for the cops... To have the GM of the Cardinals in this position, refusing to cooperate... it must have sucked for them.

A DUI from 1996 wouldn't be considered anyways - only if one in the last 7 years qualifies for a second offense

I'm pretty sure he knew his position in the organization. He was probably trying not to make it public by claiming he was someone lower than what he was. The average joe so to speak.

Until we see the BAC, I'm betting he wasn't drunk enough to not know his position. I'm betting he knew exactly how to play this out. Refuse the sobriety test to buy time getting to the jail to hopefully reduce the BAC level. Intentionally fudge his position as to not draw attention.

Sober up in the tank, get released and let the lawyers handle it.

Regarding his knees.. With is weight and any degeneration that could be happening it might be quite painful to try to balance on one knee. Not making this his excuse, but I think he was smart enough, and not drunk enough, to give himself some wiggle room.

Are you kidding? I know you'll go to the ends of the Earth to defend indefensible positions about player's ability on the field but to do the same with someone who's reckless enough to put other people's safety at risk off it is gross.

If you've got two DUIs you're a piece of a crap who never learned their lesson and keeps putting other people's safety at risk. If you want that guy to be the head of the football organization fine. But to me, that makes him human garbage and an AWFUL example for the rest of the team.

Shane can correct me if I am wrong here, but I do believe officers ask if someone has a pre-existing injury that prevents them from doing the tests. What would anyone say no?

why would he say it all? Sounds like a drunk idiot trying to sound like hot ish and "do you know who I am?" crap, but bumbling his own boast because his brain is soaked in suds. And I say that speaking from experience when i used to drink A LOT.

I would say that someone that drinks frequently can more than likely drink 2-3 beers & be safer than someone on their cell phone. I would much rather prefer riding with someone after 2-3 beers as to someone talking on their cell or constantly glancing at it.
Just because you can find something worse doesn’t make the original any better.

I’d rather be stabbed in the leg than shot in the face but that doesn’t make the stabbing any better.

The number of times one is caught also doesn’t multiply the danger of each individual act.

because people are only allowed to make the same mistake once every 23 years. not 22. burn the witch!

If you're still driving drunk after getting a previous DUI you have serious issues. And if you think this was the first time he's made this "mistake"... you know... driving a massive machine that can easily KILL PEOPLE... I've got some beachfront property in Yuma to sell you. Just because THIS was only the second time he got arrested, doesn't mean he hasn't made this mistake before. It just means he didn't get CAUGHT.

by the way @splitsecond I'm not surprised you're defending him. But being the guy who consistently defends domestic abusers (Washington) and DUI drivers is a pretty bad freaking look.
