Bonds reportedly preparing to sue Schilling

NEW YORK (TICKER) -- Barry Bonds has bolstered his legal team and could be preparing to slap a lawsuit on Curt Schilling, the New York Daily News reported on its web site Thursday.

According to the report, Bonds retained San Francisco attorney Todd Schneider and Oakland attorney John Burris to represent him in a possible defamation lawsuit against the veteran Boston Red Sox pitcher.

"There's no guarantee any action will be taken," Burris told the newspaper. "The most important thing to communicate is that Barry's silence up until now is not an admission to anything."

Bonds, who hit career home run No. 756 on August 7 to pass Hank Aaron for the most in baseball history, already is the subject of the BALCO steroids investigation and is represented by Michael Rains in that matter. The BALCO grand jury reconvenes next month.

On the HBO program "Costas Now," Schilling discussed Bonds' former mistress, Kimberly Bell, and her potentially damaging grand-jury testimony. She reportedly testified that Bonds told her about his steroid use.

"If I wrote a book about Bob Costas and in that book I wrote about Bob Costas' girlfriend being on the road, and Bob Costas giving that girlfriend card-show money and I outlined your daily steroid regimen, I've got to believe your first line of defense is to sue my (butt) off," Schilling said on the program.

Schneider and Burris issued joint statements, the newspaper reported.

"Mr. Bonds retained Schneider and Burris because of the false nature of these statements," the statement read. "While pursuing Hank Aaron's home run record, Barry felt that it was more prudent to remain silent. Now that the record has been broken, Burris and Schneider will evaluate any and all statements attributed to him that are false."

Bonds belted his 759th career homer on Wednesday night against the Atlanta Braves.

I will believe it when I see it. Is he going to sue the guys who wrote the books about him?

I hope he sues Schilling.

Schilling is a colossal blowhard, someone needs to shut him up.

No way in hell this happens. A defense to slander is that the truth was told, which means Schilling and his attorneys would be entitled to access all of Bonds' medical records, his physicians would be deposed, Bonds girlfriends/wife would be deposed about whether Bonds' nuts shrank over time, equipment requests for Bonds' baseball hats from his days at ASU to the present would be subpoenaed, etc... Bonds' attorneys must know this, and the threat is for appearance only. This lawsuit will never be filed.

Well, he didn't say slander...he said defamation of character. Is there a fine-line (or broad-line) difference between the two? I know about slander & libel, but defamation of character I'm not particularly familiar with.

Defamation of character? Doesn't that imply that Bonds has character?

That would be laughed out of court. :D

Since Schilling is such a pooze, the media are the only ones who talk/listen to him. Even his wife is probably sick of him.

Slander is defamation by speaking; libel is defamation by writing.

:thumbup: Somehow, I doubt the Honorable Judge Hand ever ruled on a motion to compel a plaintiff to disclose the circumference of his testicles.

It would be awesome if a reporter would think to ask Bonds' attorney, if truth would be a defense. There might be a chance that the atty would be caught off guard by a reporter knowing about such a thing.

So, basically, he technically isn't suing him for defamation? He's either suing him for slander or he's suing him for libel, correct? Like I said, I understand the difference between slander & libel. The article didn't mention slander OR libel, though, it just said defamation. What I'm wondering is if there is some separate legal definition for defamation, or if "defamation" is just a catch-all for slander & libel.

One of the new attorneys has defended Rodney King and Tupac in the past and was involved in the Oakland Riders case a few years ago(group of cops accused of abuse of power). So I suspect he's just hoping the guys reputation will shut people like Schilling up.

It appears his problem with Schilling relates to him profiting from what he's saying which implies he was paid to appear on that HBO show?

I agree at some point if he sues he's going to get into a situation of having
to prove its' not true. But remember he might not be complaining about steroids he might be complaining that Schilling said he gave cardshow money to his girlfriend because the way Schilling said it implied it was tax fraud.
