Great news, the Glendale City Council just voted unanimously to work to keep the Coyotes in Glendale.

the board passed a measure to create a special taxing district or some like funding mechanism to pay the league to operate the arena for next season for an amount not to exceed $25M

i'm sure there will be some legal challenges, but doubt they will stick

still need to find a long term owner, but it does look like there will be at least one more season of hockey in glendale unless things fall apart to the point where Glendale (or interested buyers) give up

I for one which something could be ironed out with IEH - I much prefer them to reinsdorf

Not so sure about that. I bet the Goldwater Institute will sue on the grounds that this violates the "gift clause" of the Arizona Constitution. It is the same tactic that brought the City North project in North Scottsdale to a screeching halt. However, I am curious why we haven't heard from these anti-tax groups yet. Maybe that means something...

I'm no legal genius, but I think this is the section that they would reference in a legal challenge. Not sure if it is appropriate or not, but it seems to be one avenue they would pursue:

7. Gift or loan of credit; subsidies; stock ownership; joint ownership
Section 7. Neither the state, nor any county, city, town, municipality, or other subdivision of the state shall ever give or loan its credit in the aid of, or make any donation or grant, by subsidy or otherwise, to any individual, association, or corporation, or become a subscriber to, or a shareholder in, any company or corporation, or become a joint owner with any person, company, or corporation, except as to such ownerships as may accrue to the state by operation or provision of law or as authorized by law solely for investment of the monies in the various funds of the state.

If the team gets sold, this "subsidy" doesn't exist. Could GW sue if no money has changed hands?

they can sue at any time .... can they win is the better question

I think there have been lessons learned on how to work around this issue and i'm pretty confident that the city will get it done

My theory of the day is that the reason we haven't heard from groups like GW yet is exactly because money hasn't changed hands yet. Thus no taxpayers have been "harmed", thus they have no standing to sue yet.

They are probably waiting like everyone else to see if onwership can change hands so that they don't have to dive into this issue and essentially advocate for taking the team away.

I called it...

Goldwater monitoring

The Goldwater Institute, which sued the city last year to ensure Coyotes negotiations were public, has raised several concerns. One issue is that the council authorized the city manager to enter the NHL agreement, which means the public will not have time to review or comment before it takes effect.

Goldwater attorney Carrie Ann Sitren said Glendale might be heading down a potential subsidy path, but that it's hard to say without seeing the details of the deal.

The Phoenix-based watchdog group has successfully challenged a Phoenix subsidy for a private development.

"The question is, what does the city get for the $25 million?" Sitren said. "Is it getting something worth $25 million to the city? If it is, it's not a subsidy."
She said it's not the city's place "to spend public resources, using their tax system and collection system to collect that money for the Coyotes."
Beasley had stressed to council that, "no one is being forced into a tax district that doesn't want to be there."

He said no residential units would be included in the district. Participants would clearly understand the economic benefits of keeping the Coyotes at the arena, where the games generate foot traffic for Westgate.

I predict that if ownership does not change hands, Goldwater Institute will cost this state its hockey team.

I think GI would lose and lose heavily - i don't think glendale would have a difficult time showing a tangible benefit ........ they were able to sneak 1 entity, but will need a new trick to grab future people ..... lawyers know their game and will craft future deals a little better to specifically account for that

unless they have a different angle up their sleeve they wont win on the same old argument

Hulsizer to bid on Coyotes

http://sports.espn.go.com/nhl/news/story?id=5521316

The Phoenix Coyotes have another interested buyer, sources told ESPN.com.

Matthew Hulsizer, CEO of PEAK6 Investments, is in the final stages of negotiating a new arena lease agreement with the city of Glendale, after which Hulsizer is expected to make an offer to purchase the Coyotes from the NHL, multiple sources have confirmed to ESPN.com…

...Another source familiar with the situation in Arizona said: "He dwarfs [Jerry] Reinsdorf when it comes to personal net worth. He's the real deal."
:bhiich:

Running out of chances Glendale, time to get very serious, now, please.
