Well the Prosecution doesn't really have a case if they don't shed a dark light on Gilbert's intentions, no matter how ridiculous that seems.

im just wondering why nothing(atleast i havent heard anything) is happending to crittendon, or is he just really that innocent?

I guess I'm naive, but how does carrying around unloaded guns constitute a "premeditated threat"? It's stupid, but that's not what "premeditated threat" means.

Since carrying the weapons around was not accidental, it was premeditated (planned). I'm just wondering if the ammunition (like magazine clips) was stored with or near the weapons. Depending upon the weapon, loading a gun is a very quick and easy process. Also the rationale for carrying the guns loaded or not is suspect. Pointing a gun at someone (loaded or not) is a threat.

According to reports, he never pointed the gun at Crittendon.

This threat can still occur. For example under the criminal offense Brandishing a Firearm, one only has to show, wave or point it in a manner which others find threatening.

But I don't think that's the philosophy behind the concept of "premeditated." And if it is, it shouldn't be. It's like saying that for me to learn certain insulting words is premeditated slander, should I ever happen to use them.

I was just trying to break down my interpretation of how a "premeditated threat" could be derived. "Premeditated" can be derived by a person knowingly possessing weapons where weapons were prohibited. Also it was apparently an act that allegedly was not an inadvertent or accidental.

Also I tried to explain how a "threat" could occur such as Brandishing a Weapon. One only has to show, wave or point a weapon in a manner which others find threatening to get to the level of a threat.

I guess one could plan and commit "defamation of character" although I understand collecting damages might be difficult. Please note I am not a lawyer but just your local, friendly, neighborhood poster on a sports discussion board.
