Not very coachable was he? Cop wanted him to walk a simple post route.

A bit of a jerk, but I expected him to perform much worse on the field sobriety test.

Will be interesting to see the results of the urine sample

yeah - he didn't seem all that messed up - i really wouldn't be shocked if the urine came back pretty clean

I think asking David to say the alphabet was a bit unreasonable. I would never expect him to get that right, or patty cake, or twinkle twinkle little star. I kind of feel sorry for the guy this time.

It does appear that the copper is looking for his 15 minutes of Tampa Bay nightly news fame there doesn't it.

When he tilted his head back with feet together you can see is upper body float to the left and then the right repeatedly. Watch the trees in the background as a reference. When he did the alphabet he was suppose to do it rhythmically to test his awareness to time. I bet he smoked some wacky tobaccy again.

Watch it again. He was supposed to do it without singing or rhythem.

Yes he did. Cops always do that. For being the ones who uphold the hold, many love to break the rules. Boston was absolutely free to call anyone he pleased and furthermore was not required to take that test. That cop was a midget dork on a powertrip. Everytime someone picks on someone too much in grade school another piggy just like that is made.

Yet, how many of us would have our field sobriety test available for anyone to watch/critique on the internet.

I agree and disagree. There are alot of good cops out there and just like everything else you have some bad ones. Cops like to tell you things and make it seem like you are breaking the law when you are not. When my friend was being arrested and charged with assault after a bar fight we were standing about 10 feet away watching. The cop came over and told us if we didnt walk away he would arrest us. I asked him for what? He said not obeying the commands of an officer or something like that. I told him we wanted to speak with his seargent because he pepper sprayed some innocent lady (which he did) He got very upset but we just stood there and he didnt arrest us.. (shocker)

He does not have a right to talk to an attorney during the field sobriety tests. He has a right to refuse the tests altogether, which the cop told him about, but if he did so, he would have probably been arrested on the basis of the refusal. After the FST's are done, he has the right to have a reasonable opportunity to talk to an attorney at a point where it won't interfere with the DUI investigation. Essentially this means, the cops have to let him talk to a lawyer if he asked for one, right before he makes the decision to provide or refuse the breath, blood, or urine test, of the officer's choosing (and it can be all three if the officer wants). If so, this usually occurs at the police station. And the cops don't have to find him a lawyer either. The way they do it here, if someone asked for a lawyer, they'll put them in the room with a phone and a phone book and say, you have five minutes. In Boston's case, he probably has his lawyer on speed dial.

My Lawyer told me if I am pulled over for DUI and even had a couple beers do not do the field sobriety tests. You really roll the dice with those. 1. You can proof you are able to drive and not impared and be let go or 2. The officer now has a ton of incriminating info that he will use in court.

You hear a of a lot of defense lawyers advising people to refuse FST's and there are arguments why you may want to refuse, but on the other side, the fact of the refusal itself can be used as evidence for the probable cause to require a chemical test. Also, the fact that the person refused to do the tests gets presented to the jury in the actual trial. In a close DUI case, it could definitely be better to take the tests. Especially if you do well on those tests and its a close BAC, maybe within the intoxilyzer's margin of error, a good defense lawyer is going to argue like hell, that the tests show their client is not impaired.

I think overall cops are good people who are going to do the right thing. that being said, it is just like any other job. There are going to be some a holes that get in.
