The deputy who arrested NFL star Joey Porter is under investigation for alleged brutality ... law enforcement sources tell TMZ.

As we previously reported, the Arizona Cardinals linebacker was busted during a traffic stop at a Taco Bell over the weekend.

Porter was busted for allegedly slapping the deputy's hand away as the deputy tried to unlock Joey's door. Joey claims the deputy manhandled him, striking him in the face.

Now we've learned CHP has launched an Internal Affairs investigation into the deputy's conduct.

The truth is it's probably something in between but as I stated before and was put down for even thinking DWB is a reality in our country "sorry Mitch I'm sure it's not with you" but unfortunately it's still a reality. I seriously doubt they would launch an investigation for no reason. Most cops are heroes but the few bad ones make it hard to trust these situations.

Joey will still be made out to look like a bad guy. But its good that this is getting looked in to. Like you said, most cops are heroes, but there are some a-holes out there.

There is no way these charges stick now. The breathalizer was marginal, he wasn't pulled over " under the influence ". Now the cop w/ a DUI pending gets rough...CHP will be lucky if Porter doesn't sue them.

UPDATE: TMZ spoke with Porter's agent, Jeff Sperbeck, who tells us, "It's unfortunate that Joey has to endure the negative fallout surrounding this investigation."

Sperbeck added, "Joey has always been respectful and supportive of law enforcement in Bakersfield; the fact that one officer acted inappropriately will not change his views. We are confident that Joey will be exonerated from any wrong doing after all the facts have been reviewed.""

I personally witnessed cops getting too rough, trumping up charges, and then lying on the stand. It involved my sober uncle at Tempe's Block Party one year. fortunately, they lied so badly on the stand the judge threw the charges out. But, not before scolding the prosecutor and the cops for about 5 - 10 minutes.

It changed how I read every police story ever since. The possibility the accused is innocent is much more realistic to me than it used to be.

Once you're involved in a situation, be it as a witness or as the person seated on the left side of the courtroom who IS NOT guilty, you get a new found perspective for why we have some of the laws we do, why we have due process, and just how good the system does work.

I am not saying the system is perfect, but a lot of times justice IS served. I know a lot of people would like to see it cut and dry, like it was in the wild west, but both sides of the story need to be heard. This is why we go to court. It sounds like the evidence surrounding the DUI charge (.07 or .08, maybe even +/-.02) is hogwash. If he did in fact slap his hand away from the door lock, is it possible the cop brushed him in the face first and that elicited the hand slapping? They will find out in court, if the whole thing isn't scraped because of this internal investigation before hand.

I got news for you, some cops lie. Some of them get into pissing matches over details with an individual and will contort their investigation to lean heavily against that person in hopes they will suffer legally. My brother was cited for trespassing at a Tempe bar for using an exit the bar didn't want him to use. He used it anyway and made it to the sidewalk before the bouncer grabbed him and pulled him back into the bar to summonse police. When the cop walked over, my brother made a derogatory remark to the officer, and found himself in the Tempe jail 30 minutes later. At the trial a few months later, his lawyer had it thrown out because my brother had already left the bar, but was physically pulled back into it by an employee and then trespassed off. The judge agreed and told my brother to have a nice life.

My brother went up to the arressting officer and attempted to apologize for his drunken behavior. The cop turned his back to him and later attempted to file other charges on him, which didn't go anywhere. Over the next 2 months after this incident, my brother received random calls from girls every friday night claiming they found his number on a bathroom stall and wanted him to come down there (the same bar). After some inquiries and the Officer being informed by his Sgt we knew it was him and wanted it to cease, it did.

My point is, it's ridiculous to say "we shouldn't have signed him" or other crap like that. Unprofessionalism, albeit more rare than common, does exsist in the Police Department(s). The Cardinals have it right, "We are aware of the situation and will monitor the events as we get more information." Let Joey Porter handle his own business...

Plus I took alot of heat for supporting Joey in the other thread when the news first broke.. So Im feeling kinda good now.. :D

If it turns out this all was trumped up and is dropped it may actually work to keep Porter on his best behavior knowing he is a target. We'll see.

I don't get how TMZ always get this stuff before everyone else.Do they have about 2500 reporters because they always seem to be first and right all the time.

Probably. That or they are just really good at guessing

I'm pretty sure that TMZ is the equivalent of Wikipedia. It is updated by quite a lot individuals and then fact checked before posting.
