Hypothetical situation

Completely off the wall and probably a faux pas somewhere in the new CBA but...


What's to stop the suns from waiving Marion for luxury tax purposes under the new stipulation, then resigning him afterwards? Of course, this assumes that he'll clear waivers, which is probably a 50/50 chance given his high salary. As far as I can tell it's possible. Marion still gets paid his, but the team gets uber relief from luxury tax implications

I'm not suggesting the suns would do this but really, it could be the answer to their possible luxury tax woes.

ok a couple things, if you waive a player you still have to pay them. and on top of that it doesnt bring you under the cap it just saves you the tax if you are going to be taxed. which is around 60 million this season. with the suns somewhere around 44-46 million right now it is very likely that we will never get close to that. so it wouldnt do the suns any good.

The rule also states that any team other than the team that waives him can sign him. So anybody could sign him but us if he clears waivers.

Also, Sean's original salary would still be on our books for the length of the contract but would not count towards any luxury tax calculations.

I believe I read the rule states you cannot sign that player again for three years after you waive him.

1) Can't sign him after you waive him

2) Can't waive him because we're not over the lux tax threshold

Right, I was aware that they still have to pay him his salary, this wasn't about that.

Also, according to Coon's FAQ linked in the other thread,

If no team claims a waived player, he is said to have "cleared waivers." The player may sign with the team of his choice at that point.

Do we know for a fact he may not sign with the original team?

I want to know, does the team with the worst record "win" the player being claimed if two teams want him? In that case the Suns are screwed having the best record! Since there are teams under the cap, this could happen. ;)
