"Making a Murderer" subject Steven Avery's new attorney, Kathleen Zellner, is highly confident she'll get the murder convict out of prison — possibly even without a new trial. That's according to Curtis Busse, which works with the Avery family to deliver information to the public.
"We're not even looking for a new trial. We're actually looking for an exoneration," Busse said in a recent interview with WIBX 950AM. "Zellner's very confident, and Steven is also very confident that it's not gonna take that much time. And we're talking months here."
When asked what new evidence made Avery and his attorney so confident, Busse answered: "Phone records, DNA, there's alibis there that weren't proven the first time that Zellner is taking to the next level and gone the extra mile to prove. They're going to show that the blood [in victim Teresa Halbach's car] and the age of the blood, it's not going to match up between the two."
And if Avery gets exonerated for the 2005 Teresa Halbach murder, he plans to make his town pay for the mistaken conviction, again. He previously filed a $36 million civil suit against Manitowoc County, in Wisconsin, and its police department after he was exonerated for a sexual-assault conviction for which he served 18 years in prison. "If they thought that [the] $36 million lawsuit was huge, a $100 million lawsuit will be a lot worse on their plate this time," Busse said.
God help him if he gets out again armed with an even more damaging lawsuit.
I'm guessing his next go-round will involve them finding a mass grave on his property.. That's if the corrupt Manitowoc County doesn't do some serious house-cleaning.

There is a fascinating precedent being set with these active crime documentaries having real life impact on these cases. Theres this one but also "The Jinx" which virtually single handedly is the reason Robert Durst was arrested.
Will be interesting to see if Wisconsin tries to re-try him

A federal appeals court has upheld a lower court ruling that the confession of Brendan Dassey, whose case was part of the Netflix documentary series Making a Murderer, was involuntary. Dassey was found guilty of helping his uncle kill a young woman in 2005, and has been held in a Wisconsin prison. The case against Dassey was constructed largely on that confession, in which he stated that he helped to rape and kill a woman named Teresa Halbach.
A three-judge panel from the 7th U.S. Circuit Court of Appeals said in its majority opinion that Dassey should be released unless the state of Wisconsin decides to retry him within 90 days or appeals to the U.S. Supreme Court.
I don't know if anyone is still interested in these kinds of shows, but Netflix just released another mini called "Evil Genius". I just binged the first 2 episodes and I'm not sure I'm going to get to sleep tonight. Talk about anxiety! This is a much weirder case and it's a bit different than Making of a Murderer, but it is fascinating to watch. And only 4 episodes.
Didn't this get re-overturned and he is still in prison? Despite any perceived guilt or innocence, I cannot fathom how anyone with eyes and ears could be comfortable with the way the police and prosecutors dealt with this kid. It was unconscionable.I can't even imagine how good it must feel for the people who made this. Documentarians goal is always to achieve change, to right wrongs in society and so rarely accomplish that.

Yep. Brendan is pretty much out of appeals at this point. His legal team is currently in the process of requesting the Supreme Court hear the case. Long shot. His best hope probably is for Steven Avery's lawyer to prove they didn't commit the crime and exonerate them.
