Do we know all the details???! I wouldn't be too quick to jump the gun sounds like he was trying to do the right thing but didn't understand how the law worksasleep behind the wheel sounds like a good thing to me??? Unless he was asleep at an intersection and was clearly driving????

Yep...you can get a dui sleeping in the back seat of the car if the keys are in the car (anywhere including your pocket or glove box). Advice to anyone who'll listen...if you do want to sleep it off in the back seat...put the keys OUTSIDE the car under a rock...even if they are touching the tire you can still get busted. They have to be 'away' from the vehicle.
I think it's garbage to bust a guy sleeping in the back seat.

The key with the way the statute is written for these sleeping cases is the "ability to have immediate control" of the vehicle. I have seen it beaten in other circumstances but yes, sleep in the back seat and put your keys in the glove box or INSIDE the console and you should be fine - unless you have an overzealous cop.

That being said, if the purpose of the substance abuse rule is to prevent substance abuse and this is a case where a player knew he had his limit and was trying to be safe - 3 games because of a technical distinction in a DUI law seems a little harsh.

So this obviously is strike 2 since the 1st positive is a freebee I believe.

I'm gonna bring it up again...how do these jackwads fail tests when they know the window of when it will happen. :trout:

DUI have different rules. automatic 2 game suspension for any DUI. More if added aggravations

If he was driving a pick-up and was found sleeping in the bed of the truck, would the same DUI rules apply? This is ridiculous.

There's a drastic difference between the guy hopping in his car and driving home and putting others at risk and trying to do the right thing and not operate the vehicle, which is the point of the law.

Sure, there's a difference, but he did more than enough to be charged. How he does in court and/or sentencing may be impacted by his story/his intent.

You are still stupid to be drunk and in "actual physical control" of any vehicle - which means you either have the keys or the keys are within your reach...or even in a location you are fully aware of.

So avoidable. Especially for a millionaire NFL player. No pity from me.

if he was at the cards facility, he definitely drove there drunk. I imagine they dont have bingers at the facility.

Yeah, it sounds like he was "behind the wheel" and not sleeping it off in the backseat like some have implied (not that it matters much).
