109 mph in a 55 mph zone!!!!! How in the heck he didnt get locked up should be the question!!!!

Yea if I pulled him or anyone over for that it would be an immediate trip to jail no questions asked.

I know in Arizona going 20 mph over usually will result in a trip to jail. But 54 mph over would guarantee it!

Usually results in a criminal citation, not a jail trip. It only results in a jail trip if you are an cornholio to the officer, or the officer is a douchebag. Physical arrest is at the officers discretion.

Yes. Thats unreal if a felony though. Not in NV. It wouldnt be. But it certainly would warrant a trip to jail either felony or misdemeanor. 109 in 55 is just plain dumb and idiotic and would warrant time in a cell to think about it.

Wow. The thing that kills me is Peterson's quote "just a little speeding ticket" He will do it again and probably kill someone or himself eventually.

No it isn't - it's a criminal offense as opposed to a civil violation - but it is not a felony, it is a misdemeanor

excessive speed, reckless driving and highway racing are all misdeamors of some class

That did sound excessive to me. However in NV all traffic offenses are considered criminal and you can be taken to jail for anyone of them. :)

Especially if the officer is a douche bag :D

Wether it is at the discretion of the officer or not, it would seem that in my experience it usually leads to arrest. I personally have been pulled over for going 22 over, and fortunately the DPS Officer acknowledged that the speed change was new. So he did lower my speed on the ticket. Pretty cool DPS officer, most cops were real cool when I was the GM of a firearms manufacturing company hahaha. Some shooting glasses and ear protection on the dash always lead to a more pleasant experience. Now that I am a slow driver I have not had any recent experiences.

hmm. It seems I may have been fed some bogus information about how they revised the reckless driving laws in our state. Off to check the statues.....

i was pretty confident, but tried to double check quickly

what I found was:

Aggressive Driving - Class 1 MD - ARS 28-695
Excess Speed - Class 3 MD - ARS 28-701.02
Reckless Driving - Class 1 or 2 MD - ARS 28-693
Racing on Highway - Class 2 MD - ARS 28-708

As noted above Excessive Speed is a C3 misdemeanor in AZ. It can be charged as anything over 85 mph or a 20 mph over the posted speed. Generally you are looking at an 3 points on the license and a fine. In Northern AZ, unofficially, if you are driving 100 or more, they are going to do a custodial arrest as opposed to cite and release. Nevertheless, if you've got your credit card handy, you are looking at a two hour time out before you're on the open road once again. Sometimes, if the facts support it they will charge, excessive speed and reckless driving on the same incident.
