Unfortunately I've seen this happen. The 2nd child that was placed in our care was a newborn from parents who's older child was pulled because of alleged abuse. Neither parent would fess up to who hurt the child so in the end all they had to do was attend classes and such and eventually they got both children back.
The DA has to go by the evidence presented. They simply cannot throw charges around. Costs money to have a trial and if you have no clear cut perp, it would be a waste of money. I know that sounds cold but it is what it is.
