Someone else on this board posted that it is now out of the alleged victim's hands. The state will pursue the matter from here and determine if the prosecution should move forward. She can only choose not to cooperate.

I heard this is true. If it is indeed the case sounds like he's not out of the woods yet & who knows what the commish may do

Yup, in domestic violence situations the state takes over. This is to protect the victim. That way the victim doesn't get threatened or beat again and decide to drop charges so the said villain wont beat them again.

And in MOST states, when a domestic violence call comes into police...SOMEONE is going to jail. I had a girlfriend in Texas who called the cops on her dad cause they were fighting....nothing really happened, no one got hit, tempers got escalated. When the cops got there, they said someone had to go to jail, that was policy. Again to protect the victim, so they don't get scared and when the cops get there say nothing happened.

I would have thought the Cardinals would have had a clause in the contract that says the large payment due next year would be pro-rata reduced to the extent Washington does not play this season because of suspensions. That certainly would help motivate him to keep out of trouble.

All cases start with a criminal complaint incident to arrest. No felony matter can proceed to trial on a criminal complaint. There must be a presentment via a preliminary hearing or an indictment returned by a grand jury. Once that occurs the complaint is dismissed having been superceeded by the indictment. From what was posted the GJ has notified the Court they have indicted Washington.

Just curious but in this age of equality, is there any difference in the eyes of the law if Washington had done these things in an altercation with say, his baby mama's new boy friend? I mean comparatively, any normal guy is going to have zero physical chance of defending themselves against someone like Washington, but is the punishment for domestic violence more severe because of the opposite gender being involved? (or is opposite gender a prerequisite for domestic violence charges?)

opposite gender is irrelevant. You can be booked for Domestic violence if it was a fight with your dad. or a male roommate or a gay lover etc... Gender has no bearing.

I didn't find out that charges against me had been dropped, one time, until I showed up for my court date. The DA didn't notify the court either. Just one very embarrassed junior prosecutor letting us all know that the city had wasted our time.

True story.

Well that was because you were busted for breaking into the Cards HQ and stealing jerseys and hats. The prosecutor knew he'd never get a conviction because you had to be insane to want to steal that stuff. :p

I've been advised by my counsel that I should assert my constitutional right to decline to answer questions under the fifth amendment.

looks like the hearing yesterday was vacated .... on the case calendar they aren't showing any future dates on the schedule as of yet .......... seems like they will still need to either schedule a preliminary hearing or go to the grand jury

cause women are never liars, they are never violent, destructive, manipulative, petty, crazy, dangerous, disrespectful and/or completely out of control. And they never, ever, ever play the "poor wittle me, I just a girl" card.

Especially when lots of money is involved.

The point is that it could be either scenario at this point, but noone other than Daryl and his Baby's mama actually know what the truth is.
