Aldon Smith has been so lucky getting out of trouble he will just get the DUI reduced to a jay walking ticket or the charges will be dropped.

Smoking weed and then deciding you want to drive to Dairy Queen for an oreo cookie blizzard... no bueno.

Preparation is key. You get the Blizzard first but have everything ready to go at home for when you get back. Haha

He denied the DUI, but he seems a bit stupid. Does he realize you can legitimately get a DUI/DWI (however they do it there) when you are on other substances?

Plus he didn't deny the hit and run and vandalism.

Just the hit and run without anything else would probably be enough for his career to implode and serve jail time.

I'm pretty sure that's considered a felony pretty much everywhere now.

Remember Aldon re-did his contract into bonuses/incentives as a commitment to the 40ers to stay clean, because before all the retirements/defections there was talk that his cap number was too high and they wanted to release him given his history. So they re-worked it so that the 49ers could basically cut bait on him at any time with little consequence if he screwed up again.

Looks like that very well might happen.

We'll see if these charges stick, but it doesn't look good for Alldone jackingusaround Smith, or the 49ers right now.

as we've talked about here before many times, California like many other states you don't even have to be legally drunk to get a DUI. If the cop thinks you're impaired, they can charge you with even if you're under the legal limit. Same for other drugs like pot etc, if they think you're impaired you can be convicted of it.

So if he did a hit and run he probably did so to avoid getting caught under the influence.

I've driven to dairy queen stoned a million times. Doesn't impair me one bit.

In general, leaving the scene creates a lot of problems in convicting someone for DUI. The two immediate problems are proving who was driving and proving the driver didn't drink/use drugs after the crash.

So perhaps he wasn't guilty of DUI, but the hit and run thing is still there. (though it would beg the question what he planned to do AFTER drinking.)

Perhaps he just tapped someone while parking, who knows, but even if true, this is why you don't use up your chances with complete idiocy, because things like this, are the straw that breaks the camels back.

Don't know what the vandalism part is though. Perhaps he purposefully backed into them, or did something to the person's car after getting out??

I'm sure we'll find out more.

His third time. You would think a person would learn the first time. Since it was in his probabtion not to drink any alcohol at all in my opinion the league should ban him for life.

If the parking lot thing is true that's the 2nd time that's happened. I mentioned it here last year, near where I live there's a strip mall kind of thing that has a taco bell, chinese food, noodle place, philly cheesesteak etc.

he was involved in an altercation in that parking lot before last season but I don't think any charges were ever filed.

I would assume the vandalism is as you guessed he either hit someones car on purpose, or did something like kick the car or snap off an antenna
