That's Super Extreme DUI

PENALTIES FOR SUPER EXTREME DUI (BAC of .20 or more)

• 45 consecutive days in jail; mandatory drug/alcohol evaluation and completion of mandatory treatment program
• Fines and costs exceeding $3,200
• 90-day driver’s license suspension (30 days no driving, and restricted license possible for the remaining 60 days)
• Ignition interlock on car for 18 months after license reinstatement
• Probation up to 5 years, possible community service
• Possible impoundment of your vehicle

If he has a couple of DUI's in the last 7 years, then

Felony DUI / Aggravated DUI: Arizona law considers a DUI as a Class 4 felony if:

• It is the person’s third DUI conviction within seven years
• The DUI occurred while the person’s privileges to drive are suspended, revoked, cancelled or refused

The minimum sentence for Class 4 felony or aggravated DUI includes:

• Minimum of 4 months in prison (maximum 3 years 9 months)
• Fines and costs of exceeding $5,500
• License revoked for 3 years
• Probation up to 10 years
• Mandatory drug/alcohol evaluation and treatment program
• Possible impoundment of your vehicle

He was arrested in 2011 for DUI while he was playing at Notre Dame.

"After receiving a citation for drunken driving on March 20, 2011, Floyd was suspended indefinitely from the Notre Dame football team on March 21, 2011. The suspension was lifted August 3, 2011, allowing him to return playing football at Notre Dame without missing any games of the 2011 season. Coach Kelly did not however allow Floyd to remain team captain, leaving senior Harrison Smith the lone captain."

I'm not sure if he had any other DUI's, I know he had a couple of underage drinking arrests.

It actually takes some effort to get to that level and unless you're Andre The Giant, mortal man is incapable of drinking that much beer. My theory is that Michael was hitting the hard stuff.

Well I learned something. I didn't know Arizona had a Super Extreme DUI law. I knew the standard DUI (.08) and the Extreme (.15).

So if he in fact got a super extreme DUI, how exactly is he not in jail right now? Do they have to charge him and go to court and that's why he's on the pats right now?

Seems like if you blew .217 they'd want to process the paperwork and get you off the roads ASAP.

I also have to agree with PFT on this, if he got that drunk while on a team plane, the Cards need to explain to the NFL how when NFL rules prohibit alcohol on team planes, someone can not only get alcohol, but get enough to get THAT drunk?

But then given the whole story it's not clear to me Floyd is actually telling the truth about where he was drinking since he's gone between I had one drink and I had 2 drinks. Unless said drinks were a bathtub full of alcohol he's clearly not telling the truth.

I agree the team does need to be investigated, but I absolutely DO NOT want this story to become about the Cardinals and how they enabled him.

This is the problem, we don't take DUI seriously.

40 years ago in the UK they took your license away for a year for your first offence ..Period .. No special circumstances like getting to school or work. 2nd offence, 3 years.

Caught driving and you go to jail and not for 45 days.

This was 40 years ago and most areas in the US have not caught up yet.

I had a friend who got a Super Extreme DUI - he didn't go to jail then. Pled down to a regular DUI (first offense) and spent 10 days in Tent City, plus 10K fines.

Right but apparently it's an NFL rule that you can't have alcohol on team planes(per PFT) and the entire intent of said rule is so you don't have players getting off the plane drunk, and driving.

So if Floyd really got drunk on the plane, to this extent, the Cards are going to be investigated and should be.

I agree Michael Floyd is responsible for his own actions, but to get THAT drunk it's not like he just hid a couple of cans of beer as he got on the plane.

But again I think it's pretty likely he's not telling the truth about where he consumed the alcohol.
