Sometimes you just can't win. Dude wasn't driving, didn't give false info and still arrested. I don't get it.

INDIANAPOLIS -- Indianapolis Colts punter Pat McAfee was arrested for public intoxication after he reportedly took a pre-dawn swim in a canal in a nightlife district.

Police arrested McAfee about 5 a.m. Wednesday in the Broad Ripple neighborhood and took him to an arrest processing center.

Officers say the 23-year-old, second-year player from West Virginia had a blood-alcohol content of 0.15 - nearly twice the level to be considered legally intoxicated.....

Officers asked McAfee if he had been swimming in the canal and he said "I am not sure," according to a police report. They asked him how he got wet and he said it had been raining, then told officers that his shirt was "in the water."

Police asked McAfee how much he had to drink.
"A lot cause I am drunk," McAfee said, according to the report.

McAfee told police that he was waiting for a friend to get him and added he planned to take a taxi home, the report said. He asked if he could walk home, but officers arrested him. They say he smelled of alcohol, his eyes were watery and bloodshot and his speech slurred. Officers said they had to help McAfee stand up after giving him a breath alcohol test.....

Yeah, I don't get the public intoxication thing. So everyone who is smart enough to not drink and drive is still going to get arrested because they're drunk in public? He couldn't walk home? They could have just given him a ride home, no questions asked.

All this is going to do is encourage more people to risk it and drive home after a night of drinking. It shouldn't be a crime unless he was being abusive or harassing people, and there are other charges for that.

Bravo to McAfee for making the right choice not to drive.

I am thinking that the swimming in the canal was the problem.

But they didn't see him swimming and unless it was a trespassing thing for swimming, I still don't get it. I live in Florida and being drunk and swimming are not mutually exclusive activities.

Why are you asking what he was arrested for. You clearly state you know exactly why he was arrested in your thread title. The swimming is completely irrelevant!

The Indiana public intox statute requires:

...the State to prove that the defendant is in a public place and in a state of intoxication caused by the defendant’s use of alcohol.

What is it with Colts kickers? Didn't their fieldgoal kicker blame alchaol on a drunken radio rant insulting and challenging teamates and coaches?

Then all they have to do is setup a checkpoint outside the exits of all bars on Friday and Saturday nights.

Wow, how many Paddy Wagons do they need for each Colts game? The Police could just walk down the rows of cars and haul people off by the 1000s.

$100 fine for PI times 30,000 times 10 games = THIRTY MILLION. Not bad.

Ta da! My point exactly. And because of this he is suspended one game and a paycheck. Wow. Maybe the Colts should be consistent and ban alcohol sales at their stadium.
