Isn't there a field breathalyzer??? If not, It would not be an obvious sign of guilt. Just a tacit sign. IMO sober people don't refuse it.

Wouldn't he have been arrested and immediately tested downtown? If so, maybe we are still waiting for the whole story.

You can refuse a field breathalyzer. The only test you are 'required' to take is a BAC and that is AFTER you have been arrested.

Nope, if you refuse they have to have sufficient evidence that your drunk to arrest you. If they already had the evidence you were drunk, then field sobriety or breathalyzer would just be to back up their case.

Citys make TONS of cash on DUI's. Cops WANT to arrest you for DUI.

Again... Unless you are an idiot... why would someone allow themselves to be arrested? This isn't John Lennon performing a sit-in. It's Joey Porter smelling of alcohol going through the TACO BELL drive in at 1AM in Bakersfield, California.

Hopefully we will get more than what we have right now. I just don't see why a bunch of cops would all lie about the details given. Especially if one of them had any idea who they were talking to.

I am no lawyer, but I swear I had heard in CA that refusal is an admission of guilt.

No because it is not a scientific test, it is biased on the officers opinion on how you performed. And an officer is ALWAYS going to say you smell of alcohol and your eyes are glassy. It gives them 'probable cause', it helps their case and its their 'judgment'.

But back on topic...Porter is an idiot

You can fail a field sobriety test by using mouthwash...

BTW how good are Cops' ofactories anyway, to be able to smell alcohol in the car?

Look at his size lol. I'd pull my gun too if some 6'3 250 lbs pound guy (in pretty ridiculous shape) got out and started walking at me. The cop did the right thing.

In our Sheriff's Office, Porter would of got tasered. We dont wrestle around with professional football players who resist arrest.

The only positive about this story is it happened now and not during the season. Odds are no suspension. Porter is an animal on and off the field. All we care about as fans are what he does on the field and 26 sacks over the past 2 seasons shows that its great he's an Arizona Cardinal!

Going to watch some UFC now.

My final take.

He is an absolute idiot.

I will chill on the void stuff until the full story comes out.

A field sobriety test is irrelevant in this case, IMHO.

Once Porter refused to cooperate with the officer, assaulted him (slapped his hand away), got out of his vehicle "in a confrontational manner," and finally was arrested once additional officers were called to the scene - why would the officers uncuff him to watch him do a field test?

Why should anybody on this board be surprised. The guy is a typical athlete in this day and age who has anger management problems.

You guys cannot be serious about voiding his contract. The man has made a massive mistake this afternoon but in no way does it justify voiding his contract. If the club makes a an example out of him by either fining him (dont know if they can actually do that ) or by giving him some other type of relevant punishment he has got it coming to him but the Cards would be absolutley foolish to void his contract because i tell you one thing no other NFL club would or has done that in the past. So you guys are a bit hotheaded and jumping the gun a bit.

Also i highly doubt the NFL suspends Porter as several other NFL players havent been fined for a first time offense like this and the NFL knows it would not get away with making a precedent out of this case.

Gotta love the moralists coming out in full force. Joeys an idiot. That was a stupid thing to do. Bottom line is this happens every two weeks with a pro athlete and talk of voiding his contract and even a suspension is just devoid of reality and jumping the gun. Hell it happened earlier this week with Ronnie Brown and thats such big news, not one other person has brought up in the thread.

As Joe said, I could see Goodell thinking Porter has made bad decisions before so I will give him a 1-2 game suspension, but the singular incident isn't going to be the reasoning. Its the previous history and even then I doubt this earns anything more then a call from the commish.

Void his contract? Really? Would you guys have voided Larrys contract had he been found guilty of misdemanor battery? I am guessing not.

Saying Joey is a ******* is prolly true. Trying to void the contract or even thinking this warrents some sort of suspension is pretty silly IMO.

I think the previous posters were talking about what should happen to him...even what THEY would do to him...not what will happen to him.

In the real world a guy would lose his job or have his monster contract heavily reduced, etc.

But this is the NFL. You can drive drunk, run a red light, kill a woman, miss a few games, and get a ring...all in the same year. Then years later you can drive drunk again and still keep your job.

IIRC, Larry's issue was not letting his girlfriend (mother of his child) leave during an argument. He didn't go "Pittman" on her and physically abuse her or bust through a window endangering his own child, etc. Character and previous incidents come into play in a situation like that.

Look for league suspension

The only way i see the league suspending him is if they decide they have had enough of Porter's attitude and decide to make an example out of him in order to curb the brash attitude's of the league's man misbehaved players. If they did that they would be going away from the actual offense which as i have stated before does not warrant suspension on its own merits, and the Porter camp would be very confident in fighting any suspension on those terms.

I just do not see anyway in which the league can justify suspending Porter for this when they have turned a blind eye to many other more grievous offences committed by its players.

Also lets be reminded that Porter is so far only suspected of having been under the influence which does lead me to believe that they couldnt confirm that by breathalyzer on the scene as we would surely have heard he WAS driving under the influence rather then suspected of DUI if the breathalyzer had confirmed their suspicion. The cops would most likely have said they suspected him of being under the influence to cover their backs.

With the other chargers i firmly believe they are most likely gonna be dropped as it is almost impossible for a court to convict Porter of assaulting a police officer by ''slapping'' him.

Maybe the NFL needs to make it a mandatory suspension if a player gets a DUI.

Maybe then these multi-millionaires would open their checkbooks and hire a driver.

No sympathy from this fan.

I know and when you think about the damage he could have caused by driving and drinking i can fully understand what they mean but its just not realistic to expect it.

With the quality of lawyer$ he can afford, it will probably end up with all charges being dropped unless they have a DA with visions of being governor.

Moe deaths and accidents are atrubutited to texting and cell phones than DUI's .. No one should be drinking and driving, thats a given.. But DUI's are from a clouded mind .. Cell phones are from sober people..

What Im trying to say is this.. Anyone can make a bad decision in the wrong mind frame.. No excuse for cell phone addicts..
