Well this is the opportune time for me to cue my default response to celebrity drunk drivers and those who resist arrest:

1) It's ok to party. Just remember that you're rich enough to hire a cab, or a limo if you think a cab is beneath you

2) The officer is always right. Never resist arrest. Even if you are bigger and stronger, a tazer is all it takes to lay you on the floor

3) It does not matter who you are or how much money you have. Never assault a police officer. Nobody is above an ass whipping

Joey Porter - you are officially a ****ing idiot in my book. Just pray that you dont get suspended and you make up for your malfeasance on the field and in the community

Dude.... Obviously the whole story has to come out.

And obviously Fitz was cleared. It's hard to say how Joey will be able to argue that he didn't refuse a field sobriety test. Or that he refused to respond to the officers.

If he was drunk.... If he struck a police officer (even if it was slapping a hand)...... etc....

Let's read about it.... That's all I'm saying.

This is not meant to be a "told you so" post, but I was one of a few who, unlike many others here were not so quick to bow down at the feet of Whiz and Graves for signing Porter.
As I said then - he's 33 with his best years behind him. To which, people here claimed he's "gonna bring an attitude unlike the Cards have ever seen"... LMAO...

I remain highly skeptical and very unimpressed by this signing...

Being skeptical, or even hating the signing is fine. Claiming this discounts him having an infectious attitude on the field is pretty stupid.

As a defense attorney, I will say in my experience, 95% of police are good people who go by the facts as they discover them. However, when it comes to DUIs the number goes way way down, and my guess is because it is such a cash cow for the state and cities involved.

Every single DUI report you will read, regardless of BAC or circumstances will say that the officer detected the odor of alcohol and that the accused had watery, bloodshot eyes. Now, I am around drunk people all the time, and very few of them actually have watery, bloodshot eyes. It has become form language police use to win a case.

Charges could be dropped and he could still be guilty, that is just how the system works. Anyway you slice it, dude was an idiot.

You also don't need to be guilty or charged with anything to break the league code of conduct policy. Commish could add everything up that made Porter look bad over the years which makes the NFL look bad and still punish him if he wanted to. No need to be in any program or have any strikes prior for the code of conduct policy.

No matter what its just horrible timing for the Cards PR wise. Everyone was all of the Cards for having such a disastrous off season, although they haven't been praised the echo's have stopped. Now the media gets to start up again and we get to all hear about how horrible it was to lose Warner, Rolle, Dansby, and so on again.

So he and his car teleported into the parking lot? Really? What are the odds he was out drinking and driving? From what was reported - pretty high, wouldn't you say?

Drinking and driving is not illegal per se.

Driving under the influence of alcohol with a blood-alcohol concentration above the legal limit is... or, at least subjectively established with a road side test.

We don't know whether that has been established.

If you just signed a 3-year, $17 million contract and are not intelligent enough to hire a driver and remove yourself from situations like this - you are an idiot and a loser. The guy is 33 freaking years old and he has no clue.

You are totally in your right to refuse a field sobriety test. In fact you SHOULD! In all US states field sobriety tests are 100% voluntarily, unless you are under 21 or on parole.

The field sobriety test is seriously flawed:

- It is not in any way a scientific test and results are notoriously unreliable. For instance, an extremely nervous but legally sober driver may be judged as intoxicated as a confident but over-the-limit driver.
- It is almost certain you will fail the field sobriety test. Your performance will be subject to the personal opinion and judgment of a police officer who already believes you are intoxicated and is therefore biased against you.
- If (when) you fail the test you will definitely be arrested for DUI and/or DWI.

And your being argumentative. If he did "Slap" an officer. If he ignored the orders of the officers. And finally if he did refuse a field sobriety test (An OBVIOUS sign of guilt) then yes.... Void away baby.

It gets worse:

"Officers pulled over a friend of Porter's in the parking lot of a Taco Bell, and Porter pulled in behind the patrol vehicle. Officers smelled alcohol on Porter and asked for his driver's license. Porter declined, and the officer asked him to leave the vehicle."

This is clearly speaking from a pragmatic standpoint, obviously he's an idiot for drinking and driving, but assuming he was drinking and driving, and considering his fame, what the hell is he thinking getting involved in a situation with cops that has nothing to do with him? Just a brain dead move.

The organization will not void his contract I can assure you. More than likely he will be suspended by Goddell.

It is? I would NEVER take a field sobriety test...NEVER. I was arrested 12 years ago for Drunk in Public and I had not had a drink in over a week. Cops abuse power all the time.

Isn't there a field breathalyzer??? If not, It would not be an obvious sign of guilt. Just a tacit sign. IMO sober people don't refuse it.

Wouldn't he have been arrested and immediately tested downtown? If so, maybe we are still waiting for the whole story.
